Delaware's Court of Chancery Welcomes New Magistrate with Deep Legal Roots
State of DE - The Court of Chancery in Delaware has a new face on the bench. On April 27, 2026, the Honorable Timothy J. Fox, Jr., was officially sworn in as Magistrate in Chancery, bringing more than a decade of courtroom experience with him.
While Magistrate Fox will handle cases across the entire state of Delaware, his chambers will be based at the Leonard L. Williams Justice Center in Wilmington.
His appointment comes after 12 years of service as a trial attorney with the Office of the U.S. Trustee at the U.S. Department of Justice in Wilmington. During that time, he worked on matters under the United States Bankruptcy Code, with a heavy focus on Chapter 11 cases.
That background in insolvency law is something the court's top judge says will make a real difference.
"Magistrate Fox is a welcome addition to our bench. His extensive trial experience will serve him well as a member of the court," said Chancellor Kathaleen St. J. McCormick. "In particular, his experience in insolvency proceedings brings a helpful skillset to the court and will enhance the court's ability to handle receivership, custodian, and dissolution proceedings, as well as petitions for the assignment for the benefit of creditors."
Magistrate Fox is a Delaware resident with roots in Virginia. He is a graduate of C.D. Hilton Senior High School in Woodbridge, Virginia.
He went on to earn his undergraduate degree from Virginia Commonwealth University, graduating summa cum laude. He later earned his law degree from George Mason University School of Law, graduating magna cum laude.
Before practicing law, he gained hands-on experience through several legal training opportunities. He completed a summer clerkship with the Prince William County Attorney's Office in Woodbridge, Virginia, a summer internship at Bloomberg BNA's Corporate Practice Series in Arlington, Virginia, and a legal externship with the Executive Office of the U.S. Trustee at the U.S. Department of Justice in Washington, D.C.
His involvement in the legal community didn't stop at his day job. Magistrate Fox has been an active member of the Delaware Bankruptcy Inn of Court since 2014 and served as Program Chair from 2023 to 2025.
He also served as an Articles Editor on the George Mason Law Review and as an INSOL International Fellow, a program that connects insolvency professionals from around the world.
With his background now brought to the Court of Chancery, Delaware's legal community is gaining someone with both the courtroom experience and the specialized knowledge the court handles on a regular basis.
His appointment takes effect immediately, and cases across the state will begin moving through his docket as he settles into his new role.
