Honduran National Convicted for Illegally Selling Firearm in Richmond
A federal jury has convicted a Honduran national on charges of possessing a firearm as an illegal alien following an undercover FBI operation in Richmond, Virginia. Joel L. Ayala-Rivera, 22, was found guilty after evidence showed he sold a handgun to an undercover FBI agent on April 15, 2024, at a Richmond apartment. As someone in the country illegally, Ayala-Rivera is prohibited by law from owning or possessing firearms. A History of Border Crossings Ayala-Rivera's history with U.S. immigration authorities goes back nearly a decade. Court records show that in 2016, he was encountered near Hidalgo, Texas, after crossing the border illegally as an unaccompanied juvenile. At that time, he was placed in removal proceedings and released to the care of his mother. He resurfaced on immigration radar in February 2023, when Border Patrol agents in Texas took him into custody again. That May, an immigration judge officially determined that Ayala-Rivera was present in the United States without being admitted or paroled. He was released from immigration detention on a cash bond. The Undercover Operation The FBI's Richmond Field Office led the investigation that ultimately brought the federal charges. Working alongside the Richmond Police Department, agents conducted a controlled purchase in which Ayala-Rivera sold a handgun at a Richmond apartment. That transaction became the basis for the federal firearms charge against him. Federal law is clear - illegal aliens are not permitted to possess firearms under any circumstances. What Comes Next Ayala-Rivera now faces up to 15 years in federal prison. His sentencing is scheduled for August 25, and a federal district court judge will determine the final sentence based on U.S. Sentencing Guidelines and other factors under the law. In addition to any prison time, Ayala-Rivera remains subject to the prior order of removal that has been in place since his immigration case was decided in 2023. The case is being prosecuted by Assistant U.S. Attorneys Angela Mastandrea and Patrick J. McGorman. Part of a Larger National Effort This conviction is part of Operation Take Back America, a nationwide initiative launched by the Department of Justice. According to the DOJ, the operation "marshals the full resources of the Department of Justice to repel the invasion of illegal immigration, achieve the total elimination of cartels and transnational criminal organizations, and protect our communities from the perpetrators of violent crime." The Richmond case is one of many being pursued under this effort across the country as federal agencies work to address illegal immigration and related criminal activity.
