Murder Suspect Who Is Medically Unfit To Stand Trial Due To Insanity is Allowed Weekend Pass and Does Not Return

State of Virginia - The Fairfax County Commonwealth's Attorney's Office is asking a judge to issue an arrest order for a man who was found not guilty by reason of insanity in a 2022 murder case and later left the country during an approved community visit.

Abdulloi Toshpulodzoda, 34, has not returned to the psychiatric facility where he was committed. Toshpulodzoda was found by law enforcement investigators to have murdered his landlord by stabbing. He had blood all over his body, and he admitted to stabbing a man to death.

However, Toshpulodzoda was found not guilty by reason of insanity of second degree murder in Fairfax County Circuit Court on October 20, 2022. He was placed in the custody of the Commissioner of the Department of Behavioral Health and Developmental Services and sent to the Northern Virginia Mental Health Institute for treatment.

On June 29, 2026, the court held a hearing and found that Toshpulodzoda remained mentally ill and in need of inpatient hospitalization. The court ordered him recommitted and stated he could not be released from custody without further order of the court.

On July 6, 2026, hospital staff approved Toshpulodzoda for a 48 hour unaccompanied pass to an apartment through the Fairfax Permanent Supportive Housing Program. He was required to return to the hospital by July 8.

Court records show Toshpulodzoda did not return to the approved location. Instead, that evening he boarded an international flight out of Washington Dulles International Airport and flew to Istanbul, Turkey, before continuing on to Dushanbe, Tajikistan.

When Toshpulodzoda failed to return to the hospital on July 8, staff placed him on escape status and issued a facility warrant. That warrant can only be enforced within Virginia, so it does not cover him if he tries to reenter the country through another state.

Virginia State Police and federal authorities have been notified, and U.S. Customs and Border Protection has issued an alert in case Toshpulodzoda attempts to return to the United States.

The Commonwealth's Attorney's Office is now asking the court to issue a capias, a judicial arrest order, that would allow nationwide extradition if he is found anywhere in the country.

Prosecutors argue the temporary pass never released Toshpulodzoda from the custody of the Commissioner or ended the court's authority over his case. A warrant has since been issued for Toshpulodzoda but he has not been located.
