APPELLATE COURT OF MARYLAND REVERSES WORCESTER COUNTY CIRCUIT COURTS DISMISSAL OF CHARGES AGAINST TYLER MAILLOUX
Worcester County, MD - The Appellate Court of Maryland reversed a previous ruling by the Circuit Court for Worcester County in August 2023. The Circuit Court had initially granted a motion to dismiss by Mr. Mailloux, citing a lack of jurisdiction.
However, on March 27, 2024, Judge Tang's opinion for the Appellate Court stated that the Circuit Court indeed had exclusive original jurisdiction over all the offenses Mr. Mailloux had been charged with. The offenses span across 17 counts, were argued to have arisen from the same circumstances.
The Circuit Court's decision to dismiss the case was deemed an error, leading to the reversal of judgment. Mr. Mailloux has now been ordered to handle all costs relating to the appeal.
Worcester County State's Attorney, Kris Heiser, expressed gratitude for the Appellate Court's opinion. He mentioned that it reinforced their belief that prosecutors had the discretion to choose where to file charges when concurrent jurisdiction existed.
Heiser remains determined to proceed with all charges against Mr. Mailloux in the Worcester County Circuit Court and is awaiting the scheduling of the trial.
