Ocean City, MD - The Town of Ocean City has been informed that on Friday, February 13, 2026, Judge Gallagher of the United States District Court granted the federal defendants' motion to dismiss US Wind's cross-claim in its entirety.

This decision represents a significant procedural victory. The Court determined that US Wind's cross-claim will not move forward. While the dismissal was issued "without prejudice," meaning the Court did not rule on the underlying merits of the claims, the cross-claim, as it was presented, has been rejected and will not proceed.

This ruling reinforces what the Town of Ocean City has consistently maintained from the start of the conversation: Ocean City has raised legitimate concerns regarding the offshore wind project and its impacts on our community, economy, tourism industry, and coastal environment. Attempts to shift responsibility or complicate these proceedings through additional claims have now been dismissed by the Court.

"We will continue to vigorously defend the interests of Ocean City's residents, property owners, and visitors," commented Mayor Rick Meehan. "Protecting the economic vitality of our resort community and preserving the character of our coastline remain our highest priorities. We are encouraged by Friday's decision and will continue to pursue this matter through the appropriate legal channels."
