Milton Man Indicted on Federal Crack Cocaine Charges

Sussex County, DE - A federal grand jury has indicted a Milton, Delaware, man on drug and firearm charges. David Harmon, 35, was charged in an indictment returned on September 10, 2026.

Court documents say Harmon had 28 grams or more of cocaine base on or about May 27, 2026. Cocaine base is commonly known as crack cocaine. Prosecutors say he had it with the intent to sell or distribute it.

The indictment also says Harmon had a loaded 9mm handgun and ammunition. Prosecutors say the gun was connected to the drug offense.

Harmon made his first court appearance and was arraigned on September 24, 2026. He appeared before U.S. Magistrate Judge Sherry R. Fallon and pleaded not guilty. The court ordered him to be held until trial.

Harmon faces three federal counts. The first is possession with intent to distribute cocaine base. The second is possession of a firearm and ammunition by a prohibited person, and the third is possession of a firearm in furtherance of drug trafficking.

If convicted, Harmon faces at least 15 years in prison and up to life. Federal sentences are usually less than the maximum. A district court judge will decide any sentence based on the U.S. Sentencing Guidelines and other legal factors.

U.S. Attorney Benjamin L. Wallace and Special Agent in Charge Charles Doerrer of the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) Baltimore Field Division announced the charges. The ATF Baltimore Field Division investigated the case with help from the Milford Police Department. Assistant U.S. Attorneys Kevin B. Smith and M. David Tambussi are prosecuting.

The case is part of Project Safe Neighborhoods. It is a Department of Justice program that brings together federal, state, local and tribal law enforcement and prosecutors. The goal is to reduce violent crime and keep communities safe.
